HMRC's use of Task Forces to target specific sectors and industries in particular geographical locations commenced in 2011 as part of its strategy to 'resource to risk'. This means HMRC using it's limited resources to focus on those areas and parts of the tax system perceived to represent the greatest risk of non compliance. Since 2011 HMRC has investigated a large number of sectors ranging from the construction industry to the medical profession.

What is a HMRC Task Force?

A HMRC Task Force is made up of a number of tax inspectors and officers covering all of the taxes commonly paid by businesses (i.e. income tax, corporation tax, VAT, PAYE etc.) The intention is to visit those businesses within the targeted sector and location and review their tax compliance and books and records (across all taxes) in a short burst of concentrated activity. This contrasts with a normal tax enquiry which tend to move at a more leisurely pace.

The success of the Task Forces means that they are likely to continued to be used into the forseable future; recent figures show the additional tax collected from Task Force activity in the last six months to January 2016 was £109m. As well as bringing in significant amounts of additional tax, the Task Forces have also passed on information gained from their activity to the HMRC Criminal Investigation teams. We have seen a number of criminal investigations and prosecutions as a result. Care therefore needs to be taken in responding to any HMRC Task Force visit.

What should I do if I receive notice of a HMRC Task Force visit?
  1. Carefully review the letter and any notice to inspect your records and/or the business premises. HMRC have specific legal powers to inspect records, obtain information and visit business premises. This means that they have hurdles which need to be overcome before they can start an investigation or demand documents. It's important to make sure that the officers have complied with the law and their own internal guidance.
  2. If you have had an 'unannounced' visit (i.e. no advance notice in the form of a letter) from the Task Force team, extra care needs to be taken. An unannounced visit can mean that HMRC thinks there are potential issues with your tax returns and business records. You should seek out specialist advice at an early opportunity.
  3. Comply with any reasonable requests for information but remember that you have the right to seek advice and can ask the officers to wait until your advisor is present. Try to keep a record of what the officers review. If they ask to remove any documents try to understand why and always get a receipt.
  4. Misunderstandings can arise, so ensure that you and/or your advisor are available to answer questions and to challenge any conclusions.
  5. Follow up any visit by asking for details of when you can expect a response from HMRC and the next steps. if the HMRC officers are non committal or vague in their response you should seek specialist advice. This may be an indication that the officers are looking to refer matters to one of the specialist investigation teams within HMRC.
  6. Make sure your advisor understands HMRC powers and processes and is able to effectively negotiate with HMRC in the event that any additional tax is payable.
